Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the B90HQ mobile application and related services (together, the “Service”) provided by B90-Industries (BAUGRUPPE90 GbR) (“we,” “us,” or “our”). By installing, registering for, or using the Service you agree to be bound by these Terms.

2. Acceptance of Terms
- You must actively accept these Terms to register or log in. During sign-up you confirm: “I have read and agree to the Terms of Service, Privacy Policy, and Community Guidelines.”
- If you do not agree, you may not use the Service. We provide material changes at least seven (7) days in advance via an in-app banner. Continued use after the effective date constitutes acceptance.
3. Eligibility & Age
- Minimum age: You must be at least 16 years old to use the Service. Where national law sets a higher age of digital consent, that higher age applies.
- Accuracy of information: You agree to provide truthful, current, and complete information (email, username, city, country) and keep it updated.
4. Description of the Service
The Service currently offers:
- A curated feed of posts, images, videos, and links shared by verified artists and approved community members
- Comments, reactions (including screws), XP scoring, and leaderboards
- A shows calendar with RSVP management and attendee visibility
- One-to-one direct messages and user search for starting new chats
- A “ScrewdlJump” mini game and other in-app activities that award XP and virtual badges
- Location tools to pick your city or precise coordinates, optional live updates, and location-based show listings
- Notification settings for artist activity, comments, mentions, direct messages, shows, XP awards, and reminders
- Profile search and discovery features (e.g., top fans leaderboard)
- In-app support, crash reporting, and feedback collection
Future features may be added; if they materially change the Service we will update these Terms.
5. Your Account & Security
- You must safeguard your credentials and notify us immediately of unauthorized use.
- You are responsible for activity occurring under your account, including direct messages and game activity.
- You may customize your profile, avatar, display name, and location preferences. Do not upload content or location data you are not authorized to share.
- You can manage crash reporting and notification preferences at any time in the Privacy and Notification settings.
6. User Conduct & Community Guidelines
- Our Community Guidelines are incorporated into these Terms. Violations may result in content removal, feature restrictions, or account suspension.
- Prohibited conduct includes harassment, hate speech, illegal activity, explicit content involving minors, extremist propaganda, spam, impersonation, privacy violations, doxxing, and copyright infringement.
- You may not attempt to circumvent safety systems, misuse reporting tools, or interfere with moderation or anti-cheat protections.
- We rely on automated signals, community reporting, and human review to enforce these rules. Reports on posts and comments may be grouped by content item and reason, weighted by account role or integrity signals, and used to trigger temporary visibility restrictions pending review.
- Final removal decisions and account sanctions are made by human moderators, even if content has already been temporarily auto-hidden by the reporting system.
7. Direct Messages & Private Interactions
- Direct messages are private between participants but still subject to these Terms and the Community Guidelines.
- We may access message metadata or content when necessary to investigate abuse, fulfil legal obligations, or resolve user reports. Unreported conversations are not routinely monitored.
- You may block or report other users. Blocking suppresses future direct messages and screws from that user.
8. Virtual Rewards, XP & Screws
- XP, screws, badges, leaderboards, and mini-game scores are virtual features with no monetary value and cannot be redeemed, transferred, or exchanged outside the Service.
- We may modify XP formulas, screw limits, or leaderboard logic to keep the experience fair or address abuse.
- Attempting to manipulate scores, automate gameplay, or interfere with XP attribution is prohibited and may lead to account sanctions.
9. Your Content & Licence Grants
- You retain ownership of content you submit (posts, comments, messages, avatars, media).
- You grant us a non-exclusive, worldwide, royalty-free, sublicensable licence to host, reproduce, modify, and display your content as needed to operate, promote, and improve the Service, including training models for spam detection and safety.
- When you delete content or close your account, we remove it from public view and purge it from active systems within the timelines set out in the Privacy Policy, unless retention is required by law or for active investigations.
- You represent that you have all rights necessary to share the content you post and that it does not infringe third-party rights.
10. Location Features
- The Service offers city-level and optional precise location sharing. You can revoke access or delete stored locations at any time.
- We rely on your provided location to tailor notifications and show listings. Accuracy cannot be guaranteed.
- Do not share locations that reveal private information of others without consent.
11. Notifications & Emails
- Push notifications are opt-in. You can control categories (posts, comments, mentions, direct messages, shows, XP awards, daily reminders) in settings.
- We may send transactional emails (e.g., security alerts, policy changes). You may not opt out of messages necessary to provide the Service.
12. Analytics, Diagnostics & Beta Features
- We use first-party analytics to track direct interactions, login events, and online heartbeats. Sentry provides crash diagnostics, performance monitoring, logs, and breadcrumbs based on your consent or lawful interest, as explained in the Privacy Policy.
- By participating in beta features you acknowledge that functionality may change, data may be incomplete, and we may roll back experiments without notice.
13. Moderation, Notice & Appeals
- You can report posts and comments directly in-app. Reports may require a category and subcategory so moderators can review the specific alleged violation.
- To protect the community, we may temporarily hide reported content before moderator review if internal thresholds are met. This is an interim safety measure, not a final determination.
- If we remove content, re-approve hidden content, restrict features, or suspend your account, we notify you with the main reasons and provide a contact channel for clarifications or appeal unless restricted by law or safety concerns.
- Reporter identities are not disclosed to the reported user, except where disclosure is legally required.
- Repeated or severe violations may result in immediate suspension. We reserve the right to retain moderation reports, decision logs, and related evidence to comply with the EU Digital Services Act, defend legal claims, and investigate abuse of our safety systems.
14. Third-Party Services
- The Service integrates Supabase (hosting, messaging, storage), Sentry (crash reporting), Vercel (web hosting and delivery), Amazon Web Services (cloud infrastructure), Apple APNs/MapKit, and other Apple developer frameworks.
- Your use of these features may be subject to additional terms from those providers. We are not responsible for services we do not control.
15. Termination
- By you: You may delete your account at any time in settings. Deletion removes your profile, direct messages, and content as described in the Privacy Policy.
- By us: We may suspend or terminate access for breaches of these Terms, Community Guidelines, or applicable law. You remain liable for obligations accrued prior to termination.
16. Disclaimers & Limitation of Liability
- The Service is provided “as is” and “as available.” We do not guarantee uninterrupted, error-free, or accurate results.
- To the extent permitted by law, we are liable only for damages caused intentionally or by gross negligence. We remain liable for injury to life, body, or health as required by German law.
- For slight negligence, we are liable only for breaches of essential contractual duties and limited to foreseeable damages typical for this type of contract.
- We are not responsible for user-generated content, third-party services, or losses caused by circumstances beyond our control (e.g., network outages).
17. Changes to the Service or Terms
We may update the Service, introduce new features, or amend these Terms. Material changes will be announced at least seven (7) days before taking effect. If you disagree, you must stop using the Service and delete your account before the effective date.
18. Governing Law & Dispute Resolution
These Terms are governed by the laws of Germany. Mandatory consumer protection rights in your country of residence remain unaffected. Exclusive place of jurisdiction is Berlin, Germany, unless mandatory law states otherwise.
